Terms of Service.

These Terms govern your use of Roll/Call. By creating an account or using the Service, you agree to them. If you don't agree, don't use the Service.

1. Who can use Roll/Call

You may create a teacher account if you are at least 18 years old and using the Service in connection with an educational or training activity. By signing up you confirm that you have authority to enter these Terms on behalf of yourself or your institution.

Students do not create accounts. They check in via a link or QR code provided by their teacher.

2. Your account

You are responsible for:

• Keeping your login credentials confidential.
• All activity that occurs under your account.
• Notifying us promptly at qrrollcall.admin@gmail.com if you suspect unauthorised access.

We may suspend or terminate accounts that breach these Terms, are inactive for an extended period, or pose a security risk.

3. Your responsibilities when using the Service

You agree that you will:

• Only add students to a roster where you have a lawful basis to do so (e.g. they are enrolled in your class and your institution permits use of third-party attendance tools).
• Comply with your institution's policies on use of external software and student data.
• Comply with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and any state privacy or education laws applicable to you.
• Provide students with appropriate notice about how their information will be handled (our Privacy Policy is available to support this).
• Not use the Service to harass, surveil, or discriminate against any student or staff member.
• Not attempt to circumvent, probe, or stress-test the Service's security controls, scrape data, or reverse engineer the Service.
• Not resell or rebrand the Service without our written agreement.

You acknowledge that you — not us — are the controller of any student personal information you enter into the Service, and you are responsible for the lawful basis for collecting it. We process that information on your behalf and under your instructions, as described in our Privacy Policy.

4. Fees and payment

Paid plans are billed in advance on a recurring basis at the price listed on our website (currently A$10 per month). Prices are in AUD and inclusive of GST where applicable. You authorise us and our payment processor (Stripe) to charge the payment method on file. If a payment fails, we may suspend access until it is resolved.

You can cancel at any time from your dashboard. Cancellation stops future renewals; we do not refund partial billing periods unless required by law.

5. Our service commitments

We will use reasonable efforts to keep the Service available and secure. We do not guarantee uninterrupted availability. We may release updates, change features, or temporarily suspend the Service for maintenance.

6. Intellectual property

We own the Service, including the source code, design, branding, and documentation. These Terms do not transfer any of that to you. You may use the Service only as permitted by these Terms.

You retain ownership of the class and roster content you enter. You grant us a non-exclusive licence to host, process, and display that content as necessary to provide the Service to you.

7. Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

8. Consumer guarantees and limitation of liability

Our Service comes with guarantees that cannot be excluded under the Australian Consumer Law ("ACL"). Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the ACL or other laws that cannot be excluded by contract.

To the maximum extent permitted by law, and subject to the paragraph above:

• The Service is provided “as is”. We exclude all implied warranties not required by law.
• We are not liable for indirect, consequential, special, or punitive loss, loss of profits, loss of revenue, loss of goodwill, or loss of data.
• Where our liability for breach of a non-excludable consumer guarantee for services can be limited, our liability is limited (at our option) to resupplying the services or paying the cost of having the services resupplied.
• Our total aggregate liability to you in any 12-month period is capped at the greater of (a) the fees you paid us in that period, or (b) A$100.

You acknowledge that the Service is an attendance tool. Decisions about whether a student is marked present, absent, or has met any attendance requirement are made by you, not by us. We are not responsible for academic, disciplinary, or administrative consequences arising from attendance records.

9. Indemnity

You indemnify us against any claim, loss, or cost (including reasonable legal fees) arising from:

• Your breach of these Terms;
• Your unlawful collection or use of student personal information;
• A third party's claim that your use of the Service infringed their rights.

This indemnity does not apply to the extent the claim is caused by our wrongful act or omission.

10. Suspension and termination

You can terminate your account at any time by deleting it from the dashboard or emailing us. We can terminate or suspend your account if you materially breach these Terms, fail to pay, or use the Service in a way that creates legal or security risk.

On termination, your right to use the Service ends. We will delete your account data within 30 days, except where we are required to retain it by law (e.g. billing records).

11. Changes to these Terms

We may update these Terms. If we make a material change, we will notify you by email or via the dashboard at least 14 days before it takes effect. Continued use after that date constitutes acceptance.

12. General

• Governing law: these Terms are governed by the laws of [TODO STATE], Australia. You and we submit to the exclusive jurisdiction of the courts of that State.
• Assignment: you cannot transfer these Terms without our consent. We can transfer them to a successor (e.g. on a sale of the business).
• Severability: if any provision is unenforceable, the rest stays in effect.
• No waiver: failure to enforce a right is not a waiver of that right.
• Entire agreement: these Terms and the Privacy Policy are the entire agreement between us about the Service.
